Fintiv Inc. the mobile commerce platform is an Austin based company that claims to sue Apple for Apple Pay infringement on an acquired Korean patent that Fintiv owns. The Texas-based company claims to have been working on mobile payment, loyalty offering technologies for over 20 years.

The uploaded lawsuit covers storing and using digital wallet data on a mobile device regarding billing agreements or online purchases. The patent claims it as an infringement action to end the defendant’s unauthorized and infringing manufacture, use, sale, offering for sale, and importation of methods and products incorporating Plaintiff’s patented inventions.

Fintiv, has been and is presently directly infringing at least claim 11, 18, and 23 of [the Patent], as infringement is defined by 35 U.S.C. § 271(a), including through making, using (including for testing purposes), selling, offering for sale, and/or importing infringing products. Apple is thus liable for direct infringement of [the Patent].

It also asserts that Apple has indirectly infringed the 125 Patent by inducing and contributing to infringement by others, including Apple device users, card issuers, and card issuer’s authorized service providers.

The company claims that infringing products include Apple iPhone devices, Apple Watch devices, and the Apple Wallet Application. Earlier in July Apple was sued for allegedly infringing on a company’s patents because of Siri’s natural speech recognition.
